Risks and liability-release form for the services provided by TeoToursMx

Be assured that TeoToursMx and its staff take every possible care and precaution to ensure that your trip with us is as pleasant and safe as possible. However, due to the nature of the services provided, you may be exposed to certain risks. TeoToursMx acts solely as an intermediary agent between the client and the providers of the tourist services promoted on this website: https://www.teotours.com. The agency carefully selects only the most qualified and reputable providers to deliver the best service. Nonetheless, TeoToursMx cannot assume any responsibility for acts or omissions by affiliated providers, as it has no control over or legal relationship with their operations. It is important that you carefully read the following rules before signing, understanding that you participate in this tour at your own risk, releasing TeoToursMx from any civil, criminal, or other liability arising from the use of its services.

General Terms and Conditions

 

1. Every passenger must follow the instructions of TeoToursMx guides and staff, as well as those of its affiliated providers, at all times. If I do not understand any instructions, I acknowledge that it is my responsibility to seek assistance from the guide.

2.  I recognize that it is important to wear the appropriate clothing for the activity.

3. My personal and/or valuable belongings are my sole responsibility during the activities, and I carry them at my own risk. TeoToursMx, its staff, or providers are not liable for lost, stolen, or damaged items such as cameras, binoculars, cell phones, etc.

4. The tour may include uphill walks and uneven terrain.

5. People under the influence of alcohol and/or drugs will be denied access to the tour.

6. I must respect the flora and fauna, as well as the rules and policies of each place visited during the activities.

7. TeoToursMx reserves the right to use any image of you captured during the tour for promotional or advertising material.

8. The use of sunscreen is recommended during outdoor tours.

9. The photographs shown on the website are representative and do not guarantee that everything will be exactly the same upon my arrival.

10. I must inform the guide, driver or captain during the trip about any injury, accident or dissatisfaction related to the service, safety or quality, since TeoToursMx will not accept subsequent claims.

11. You can reschedule the date or time of your experience, as well as add or remove participants, within 24 hours of booking and up to 72 hours before the scheduled start of the experience.

12. If you reschedule an experience, the cancellation policy is based on the original purchase time and start date of the experience.

13. No-show on the day of the activity will result in a 100% charge of the deposit.

14. In case of bad weather (rain or wind greater than 20 km/hr), for your safety the flight will be cancelled and rescheduled on a date of your choice (subject to availability) or a refund will be granted depending on the services offered up to that moment and in accordance with our cancellation policy.

15. It is very important that the details provided when booking (such as weight and health conditions) are true. The maximum weight allowed per passenger is 100 kilos. I understand that additional charges may apply if I exceed this limit.

16. I confirm that I do not have a fear of heights, heart problems, walking difficulties or other serious medical conditions, and that I am not pregnant.

17. During the balloon flight, I am responsible for following all the pilot's instructions until landing.

18. It is strictly forbidden to touch connections, tanks or ropes inside or outside the balloon. Failure to comply with these rules may result in cancellation of the flight, without the right to a refund.

19. The estimated flight time is 40 to 60 minutes. If for safety reasons the pilot decides to reduce this time, there will be no reason for reimbursement.

20. It is prohibited to board the balloon with backpacks, suitcases or bags. These objects must be left in the lockers at the facilities or in the car before boarding.

21. Smoking is strictly prohibited in the take-off area, during the flight and upon landing.

22. The flights take place over the Teotihuacan Valley. The approach to the pyramids is not guaranteed; the overflight of the Archaeological Zone will depend on wind conditions.

23. I recognize that TeoToursMx is not responsible for adverse weather conditions or schedule changes due to weather. If conditions prevent the experience from continuing, TeoToursMx may cancel and charge a partial fee for services offered up to that point.

24. I acknowledge and accept the inherent risks of this activity, including possible personal injury or damage to my property. I assume all risks and release TeoToursMx from any liability.

25. I agree not to sue TeoToursMx, its employees or affiliates for any reason related to my participation in the tour.

26. If any provision of this document is declared void, the remaining agreements will remain in force.

27. The parties agree to submit to the jurisdiction of Mexico, waiving any other jurisdiction due to residence or other cause.

28. For security reasons, TeoToursMx reserves the right to refuse admission at any time.

 

General Restrictions

 Some activities are restricted to pregnant women.

Some activities are restricted to children under 4 years old.

All activities are restricted to people who have consumed alcoholic beverages and/or drugs.

All activities are restricted to people with cardio-respiratory problems.

All activities are restricted to people with recent surgeries or spinal and/or knee problems.

Some activities are restricted to people with mobility problems.

Some activities are restricted to people with vertigo or altitude sickness.

Reservation Policy

The rates shown on our website (https://www.teotours.com) they are valid only at the time of the quote and may change without prior notice until they have been reserved and confirmed.

A reservation is considered confirmed when the full payment or the corresponding deposit has been made and the documents proving the cardholder's identity have been sent, if requested. Otherwise, availability and rates cannot be guaranteed.

Availability must be verified directly with your sales consultant before a service can be confirmed. We will not ask for any payment until availability is confirmed.

At the time of booking you authorize in writing and/or verbally to use your credit card number or the chosen method to make your payment, and expressly confirm that you know and accept our Reservation Policy, and all our Terms and Conditions.

In case your reservation has an outstanding balance, you must cover the fee with the local guide at charge, by paying with a Credit/Debit Card or cash to give you access to the service (card payments generate an additional 3% charge).

If you want to modify your reservation, it is necessary to contact an advisor 72 hours in advance.

Any reservation change is subject to availability, a re-quotation of rates and in certain cases a service charge for changes. In case of cancellation we ask you to read our CANCELLATION POLICIES, we also remind you that some of our services are non-refundable.

Payment Policy

To pay for your reservation, we accept American Express, Visa and MasterCard credit/debit cards. For security reasons and to avoid unauthorized charges, in some cases you may be asked for supporting documents, the purpose of which will be to confirm the identity of the cardholder, such as a charge authorization letter with signature, official identification with photo and a copy of the card. If the required documentation is not sent within the established period, the reservation will be considered cancelled and will be subject to the cancellation policies.

ONLINE PAYMENTS, TRANSFERS AND DEPOSITS.

  1. The client is obliged to send via email or WhatsApp proof of the payment(s) made to TeoToursMx and verify that the agency received said payment, leaving TeoToursMx free of any liability in the event that the client has no way to verify the payment.
  2.  If the client makes payments and does not notify the agency, it is understood that the agency has no way of finding out and/or applying said payments to its account, in such a way that TeoToursMx is free of any responsibility that may arise from this situation, since It is the client's absolute responsibility to inform the agency of the payments made or paid in favor of the services previously contracted. and having no right to any claim for cancellations or refunds due to this situation

3. The charge to your debit or credit card will be made until the reservation status shows “availability confirmed”, the charge will be reflected in your account statement including the legend “TeoToursMx”, “teotoursmx@gmail.com”.

4. The rates published on the site https://www.teotours.com are listed in Mexican Pesos MXN  and/or  US Dollar USD, in case your currency is different from these, the transaction amount will be charged to your card in Mexican Pesos MXN  and/or  US Dollar USD at the exchange rate in effect on the day of the transaction. Please note that the amount that will appear on your credit card payment receipt may vary by up to 3% due to international fluctuations in bank currency exchange rates. TeoToursMx is not responsible for such fluctuations. You acknowledge that you have been informed of the exchange rate fluctuation and agree to the corresponding charge.

We are not responsible for reservations made through sites not provided on this page or with unauthorized providers.

Cancellation and Refund Policy

All cancellation requests must be requested by email (galicia@teotours.com) and directly to the advisor in charge of your reservation through the WhatsApp number.

You can get a refund if you cancel at least 7 days before the start date of the experience or within 24 hours of purchase (except for last-minute bookings).
If you cancel after time or something prevents you from attending the trip, there will be no refund.

All refund  will generate an administrative charge of 15% of the total value of the contracted services in addition to the penalty assigned by the corresponding provider.

There are no refunds on Gift Card purchases. The Cancellation Policy applies from the date chosen by your guest.

For reservations that include accommodation, cancellation must be made at least 72 hours prior to arrival or we will not issue any refund.

In high seasons (Christmas, New Year, Holy Week, Easter, Day of the Dead, July and August) The modification of reservations is totally subject to availability, this includes reservations with lodging, food and transportation services. In addition, it is requested that for these seasons the modifications be made with 15 days in advance for accommodation, balloon flight and transportation services. Any change made before the aforementioned time may result in an additional charge of 30% to the total rate for administrative expenses or whatever is determined within the policies of each hotel or service provider, since each one has its own policies and in some cases, specifically for the high season, no rescheduling or modification is possible.

Reservations cancelled outside the time stipulated in this Policy, regardless of the reason for the same, are subject to the charge policies for NO SHOW in which NO refunds or date changes will be made.

When the passenger decides for any reason to desist from any activity or service during the period thereof, it is understood that it is under his or her own responsibility and that the agency is free of any responsibility and there will be no refund.

TeoToursMx is not responsible for any change in itinerary, or for any change or error in data provided by you for the issuance of your service, such as names, surnames, ages, dates, etc.

Once TeoToursMx receives the amount for the contracted services from you, TeoToursMx has your immediate authorization to issue, dispatch or acquire the requested services in your name, adhering to and accepting the cancellation, issuance and ticket sales policies of the service provider companies and the Reservation and Cancellation Policies of TeoToursMx.

Cancellation due to weather

 

If weather or another event beyond our control prevents us from carrying out the activities before the start of the experience, we will cancel and you will receive a full refund, considering only the discount for transfer and currency exchange fees.

If weather or another event beyond our control prevents us from continuing with the experience activities, a partial refund will be given based on the services provided up to that point.

 

Cancellations due to minimum number of travelers.

It does not apply when booking on this website, because we manage the availability of our tours in real time.

 

I have read and fully understood this document and acknowledge that there is no error, bad faith or cause for nullity. I accept and sign accordingly.
